THE REGULATIONS OF THE COMPETITION „[REBELHORN EICMA]

[General provisions]

  1. This regulations (the „Regulations”) specifies the terms and conditions of conducting the competition under the name „[REBELHORN EICMA]” (the „Competition”).
  2. The Organiser of the Competitions is Polish company "Powerbike" spółka akcyjna with its registered office in Dąbrowa, at Batorowska 20, Dąbrowa, 62-070 Dopiewo, Poland, entered into the register of entrepreneurs kept by the District Court for Poznań - Nowe Miasto i Wilda in Poznań, VIII Commercial Division of the National Court Register, under the KRS number: 0000398622, share capital in the amount of PLN 2.171.875,00 fully paid, holding Tax Identification Number (NIP): 7811756729, REGON: 634638849, address e-mail: [***] (the „Organiser”).
  3. The Organiser is the founder of the prizes.
  4. The Competition is conducted only during trade fair event: the International Motorcycle and Accessories Exhibition (EICMA), which takes place in Milan 8th November 2024 and 9th November 2024 (“EICMA”).
  5. The Competition is not created, administered, conducted, supported, endorsed or sponsored by or associated with Instagram.com (“Instagram”). Instagram is a registered trademark of Instagram, LLC. Instagram is completely released from liability by each participant of the Competition.

[Participants]

  1. The participant of the Competition (the “Participant”) can be each nature person, which has jointly the following features:
  2. age of majority,
  3. full legal capacity,
  4. consumer status.
  5. The condition for participation in the Competition is to read the Regulations and accept them voluntarily.
  6. By participating in the Competition, the Participants declare that they:
  7. accept the Regulations,
  8. undertake to comply with the Regulations,
  9. meet the criteria referred to in section 1 above.
  10. Employees and associates of the Organiser, as well as members of their immediate family (spouses, ascendants, descendants and siblings) and persons cohabiting with them cannot participate in the Competition.

[Detailed terms of the Competition]

  1. The Competition lasts on 8th November 2024 and 9th November 2024, but the results of the Competition shall be announced until 10th November 2024.
  2. In order to take part in the Competition, the Participant should complete the following activities on Instagram:
  3. taking a photo with use of photo frame of brand Rebelhorn placed on the Organiser’s stand at EICMA,
  4. on 8th November 2024 or 9th November 2024 sharing the photo on the Participant's story on Instagram and tagging the shared photo with the profile names: @rebelhorn.official and @eicmaofficial (the activity is deemed as performed only if the Participant’s profile is public at the time of sharing).
  5. The Participant may submit only one photo to the Competition.
  6. After the duration of the Competition, a commission consisting of 5 people, appointed by the Organiser, will select, from among the photos of the Participants, who performed all the activities indicated in section 2 above, 1 photo that, in its opinion, will represent the greatest artistic value.
  7. The winners of the Competition will be announced at the website: rebelhorn.pl and at profiles of this brand in the social media (i.e. on Instagram and on Facebook).
  8. After the announcement of the results of the Competition, the Participant indicated as the winner should send, not later than until 17th November 2024, the following data in the form of a private message on Instagram addressed to the profile of brand Rebelhorn (so: official):
  9. name and surname,
  10. address in the territory of the European Union to which the prize should be sent,
  11. phone number,
  12. e-mail address.
  13. Failure of the Participant to send information in accordance with section 6 above shall be deemed a waiver of the prize.
  14. As a moment of sending the message on Instagram, mentioned in section 6 above, is considered the moment of its receipt by the Organiser.
  15. The Participants are aware of the fact that the tagging the shared photo pursuant to section 2 (b) above, serves the commercial i.e. marketing, promoting and advertising, purposes of the Organiser. They give their consent to it by participation in the Competition.

  1. The prize for the winner of the Competition is: any motorcycle jacket from Rebelhorn collection. The maximum total value of the prize is 849,90 EUR.
  2. The prize should be sent by the Organiser to the indicated address of the winner until the 10th December 2024, at the Organiser’s expense by courier.
  3. The prize cannot be exchanged for cash or any other prize.
  4. If the winner waives the prize, he is not entitled to any equivalent, including a cash equivalent.
  5. Failure to collect the prize by the Participant and its return to the Organiser by the carrier is deemed as a waiver of the prize.

[The Organiser’s liability]

  1. The Organiser is not liable for any technical problems beyond the Organiser's control that affect the course of the Competition.
  2. The Organiser is not liable for any behaviour of Participants that is inconsistent with the law, the Regulations or the regulations of the Instagram portal, such as, in particular:
  3. posting by Participants, in connection with the Competition, incomprehensible or illegal content, such as, in particular:
  4. violating the rights of any third parties,
  5. inciting hatred,
  • offensive, contrary to law and customs, especially vulgarisms,
  1. containing personal data of third parties,
  2. promoting totalitarian systems,
  3. advertising and marketing,
  • pornographic,
  1. taking actions using a third party account (profile) or a fictitious account (profile),
  2. interfering with the operation of Instagram in connection with the Competition,
  3. violation of intellectual property rights of any third parties.
  4. The violation of any provision of the Regulations excludes a given Participant from the Competition, including depriving him of the right to receive a prize.

[Complaints]

  1. Participants should submit any complaints regarding the competition in writing or by e-mail to the address or e-mail address of the Organiser indicated in § 1 section 2 of the Regulations within 7 days from the date of the event, which is the cause of the complaint, but no later than on 31st December 2024.
  2. The Organiser will respond to the Participant's complaint immediately, but no later than within 14 days from the date of its receipt, unless the provisions of generally applicable law in a given case provide for a shorter period. The response will be sent to the address or e-mail address from which the complaint was sent.

[Personal data]

  1. Pursuant to article 13 section 1 of the General Data Protection Regulation dated 27th April 2016 („GDPR”) the Organiser hereby informs that the administrator of the personal data of the Participant will be the Organiser i.e. Polish company "Powerbike" spółka akcyjna with its registered office in Dąbrowa, at Batorowska 20, Dąbrowa, 62-070 Dopiewo, Poland, entered into the register of entrepreneurs kept by the District Court for Poznań - Nowe Miasto i Wilda in Poznań, VIII Commercial Division of the National Court Register, under the KRS number: 0000398622, share capital in the amount of PLN 2.171.875,00 fully paid, holding Tax Identification Number (NIP): 7811756729, REGON: 634638849 (the „Administrator”). The contact with the Administrator is possible by correspondence to the address given above or in electronic form to the following e-mail address: [***].
  2. As part of the Competition, it may be necessary to process the personal data of the Participants:
  3. the name of the profile (account) on Instagram,
  4. name and surname,
  5. phone number,
  6. e-mail address,
  7. address with the postal code.
  8. Data indicated in section 2 above, are provided by the Participants voluntarily, and their use is limited only to activities necessary for the implementation of the Competition and are stored in accordance with the applicable law on the protection of personal data. The Administrator declares that it processes Participants' data in accordance with Art. 6 section 1 (a) of GDPR.
  9. If the Administrator receives other personal data from Participants than those indicated in section 2 above may also process them for the purposes indicated below.
  10. Participants' personal data will be used by the Administrator for the following purposes:
  11. related to the organization and conduct of the Competition, including selecting the winner, announcing the results of the Competition and possible complaint proceedings,
  12.  By participating in the Competition, the Participant consents to the Administrator's processing of data provided by the Participant in accordance with the Regulations in order to fulfil justified purposes related to the performance of obligations arising from the Competition towards its Participants. The consent expressed by the Participant constitutes the legal basis for the processing of the Participants' personal data. Fulfilment of obligations consists in particular in awarding and issuing prizes and performing activities as part of the complaint procedure.

  13. The consent to data processing is voluntary. Refusal to provide data or subsequent withdrawal of the consent to their processing results in the inability to participate in the Competition.
  14. The recipients of the Participants' personal data will be employees and persons cooperating with the Administrator. Personal data may also be transferred to the necessary extent to entities cooperating with the Administrator as part of the implementation of the above-mentioned. purposes (such as courier companies, IT service providers, hosting service providers, e-mail providers, etc.), and may also be transferred to third parties in connection with the Administrator's implementation of its rights and obligations (e.g. courts, tax offices).
  15. Participants have the right to access their personal data at any time and the right to rectify, supplement, delete, limit their processing, the right to transfer data, the right to object and the right to withdraw previously expressed consent to the processing of personal data.
  16. Withdrawn consent at any time does not affect the lawfulness of data processing carried out on the basis of the consent given by the Participant before its withdrawal. The Administrator hereby informs the Participants about their right to lodge a complaint with the supervisory authority (in Poland: Prezes Urzędu Ochrony Danych Osobowych – The President of the Personal Data Protection Office, in Italy: [***]) if it is found that the processing of personal data within the scope of this consent violates the provisions of the GDPR.
  17. Participants' personal data will be stored for the duration of the Competition and the completion of activities related to it after the end of the Competition. Personal data will also be stored after this period for the period required by applicable law or the period needed by the Administrator to protect or enforce its rights.
  18. The Administrator does not provide for the transfer of Participants' personal data to a third country.
  19. Participants' personal data will not be processed automatically or profiled.

[Final provisions]

  1. The Regulations are exposed at the Organiser’s stand during EICMA. The Regulations are also available free of charge on the website: www. rebelhorn.com in a way that enables their acquisition, reproduction and recording.
  2. In matters not regulated in the Regulations, the provisions of Polish law shall apply.
  3. The Regulations do not violate any mandatory legal provisions granting consumers specific rights and should be interpreted only in accordance with these provisions.
  4. The Organiser reserves the right to change the Regulations until the start of the Competition.
  5. The Regulations enter into force on 08.11.2024.
